Terms and Conditions
These general terms and conditions apply to all services provided by Sun Life Real Estate N.V., located at Mambo Beach Boulevard 38A, Curaçao (hereinafter: "Sun Life" or "Supplier"), acting as a provider of services to clients or customers (hereinafter: "User").

General
"Service" means all services provided by Sun Life, including real estate advice, the offering of properties for sale or rent, acting as intermediary in the purchase, sale, rental or leasing of properties, and conducting negotiations on behalf of clients. Deviations from these terms and conditions are only valid if agreed in writing.
If any provision of these terms is found to be invalid, the remaining provisions will remain fully effective. In such a case, the parties shall consult each other to agree on a replacement provision.
Sun Life reserves the right to unilaterally amend these terms and conditions. The amended terms will be communicated to the User in a timely manner and shall be binding if the User continues to use the service.

Services, Prices and Payment
Sun Life offers both non-binding and paid services. Fees are agreed upon in advance and are, unless otherwise stated, inclusive of the applicable sales tax (OB) in Curaçao. Payments must be made within the agreed term. In case of late payment, the User will be in default without the need for a notice of default.
If payment is not made, Sun Life is entitled to suspend its services until full payment has been received. Any additional costs, including collection fees, shall be borne by the User.

Mediation and User Obligations
When issuing an assignment for mediation, the User declares to be authorized to sell or rent the relevant property. The User is responsible for providing accurate information, photos, and documentation.
The User indemnifies Sun Life against any liability resulting from incorrect or incomplete information about the property.

Liability
Sun Life undertakes to perform its services with due care but accepts no liability for damages arising from advice, information, or mediation, unless such damage is the result of intent or gross negligence.
Sun Life is not liable for indirect damage, including consequential damage, lost profits, or missed savings. Liability is in any case limited to the amount paid out under the applicable liability insurance.

Intellectual Property
All information, photos, documents, and marketing materials prepared or published by Sun Life remain the property of Sun Life, unless agreed otherwise in writing. Use by the User is only permitted with prior written consent.

Privacy and Data Protection
Sun Life processes personal data in accordance with the privacy laws of Curaçao. Please refer to our separate Privacy and Cookie Policy for more details on how we handle personal data.

Complaints
Complaints about the services provided must be submitted in writing or by email within 14 days after delivery. Sun Life will make reasonable efforts to handle the complaint in a timely manner and, if justified, offer an appropriate solution.

Applicable Law and Disputes
All agreements with Sun Life are governed exclusively by the laws of Curaçao. In case of disputes, the parties will first attempt to resolve them amicably. If resolution is not possible, the competent court in Curaçao shall have exclusive jurisdiction.

Final Provisions
The User is obliged to promptly inform Sun Life of any changes in contact details or other relevant information. Sun Life is not liable for delays or errors resulting from the User’s failure to provide up-to-date information.
